Candid Canyon (#CandidCanyon) Photo Contest Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OR OLDER AT THE TIME OF ENTRY. VOID IN PUERTO RICO, U.S. TERRITORIES AND POSSESSIONS OUTSIDE THE 50 UNITED STATES, CANADA, AND WHERE RESTRICTED OR PROHIBITED BY LAW.

PRELIMINARY INFORMATION: The Candid Canyon (the “Contest”) starts on October 1, 2021, at 8:00 AM Mountain Standard Time (“MST”) and ends on October 30, 2021, at 11:59 PM MST (the “Promotion Period”). Sponsor’s computer is the official time-keeping device of the Promotion. The “Sponsor” of the Promotion is Flowers Bakeries, LLC, 1919 Flowers Circle, Thomasville, Georgia 31792. The “Administrator” of the Promotion is Kinship Creative, 630 S Bertelsen Rd, Eugene, OR 97402.

ELIGIBILITY: The contest is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older or the legal age of majority in their jurisdiction of residence at the time of entry, whichever is older. Employees of Canyon Bakehouse LLC (“Sponsor”), its subsidiaries, affiliates, promotion, and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state, and local laws. This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook. The information you provide will be used for the purposes of Contest administration.

HOW TO ENTER: During the Contest Period, take a “candid Canyon” photo of where you’re finding Canyon Bakehouse products in-store or at home, then post the photo to one of the two (2) social media channels designated below and include the designated hashtags/tags below (each social media post qualifies as an “Entry”);

1) Instagram: Login to your Instagram account and (i) post your photo along with a caption that describes your photo; (ii) include the hashtag #CandidCanyon in your post; (iii) tag the retailer where you purchased, and (iv) tag @canyonglutenfree to receive one (1) Entry. You must follow @canyonglutenfree on Instagram to be eligible. OR

2) Facebook: Log in to your Facebook account and post your photo to the Canyon Gluten Free Bakehouse Facebook page at www.facebook.com/canyonglutenfree.com along with a caption that describes your photo and includes the hashtags #CandidCanyon in your post to receive one (1) Entry.

Limit of one (1) Entry per person per social media channel per day throughout the Contest Period.

JUDGING PERIOD: All eligible Entries received will be judged by a panel of qualified judges based on the following criteria: (i) creativity and composition of Entry (33%), (ii) originality and photo quality of Entry (33%), and (iii) Entry presentation (34%) (the “Judging Criteria”). The eleven (11) Entries with the highest scores will be deemed potential winners.

WINNERS NOTIFICATION: Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest. Potential winners will be notified by direct message on Instagram or Facebook on or about November 1, 2021, and will be asked to respond within five (5) business days and provide their full name, telephone number (including area code), date of birth, mail and/or email address consistent with the Entry requirements. Return of notification as undeliverable, failure to sign and return requested documentation or finalist submission within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period, or noncompliance with these Official Rules by a potential winner will result in disqualification and, at Sponsor’s sole discretion, a runner-up may be notified.

PRIZES (11): One (1) Grand Prize Winner will receive a $100 gift card to a grocery store of their choice and a Canyon Bakehouse Bread Box. Twenty (20) runners-up will each receive five (5) Canyon Bakehouse VIP Coupons. Approximate Retail Value (“ARV”) of the grand prize is $150. Approximate Retail Value (“ARV”) of runner-up prizes is $35.

GENERAL RULES OF PARTICIPATION: By participating in this Promotion, participants agree to be bound by these Official Rules. All federal, state, and local laws apply. Any attempted form of participation in the Promotion other than as described herein is void. Entries received from any participant in excess of the stated limitation will be void. Multiple participants are not permitted to share the same email address. If it is discovered that a participant attempts to receive additional entries in excess of the stated limitation, including, without limitation, if a participant is found to use multiple email addresses to enter this Promotion, that participant may, at Sponsor’s sole discretion, be disqualified from the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, the “authorized account holder” (determined at the time of entry) of the account used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to the email address through the email platform. Potential winners may be required to show proof of being the authorized account holder.

Sponsor reserves the right to disqualify any individual found, in Sponsor’s sole discretion, to be tampering with the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of the Promotion. Any use of robotic, automatic, macro, programmed, third-party, or like methods to participate in the Promotion may void any attempted participation effected by such methods and may result in the disqualification of the individual utilizing the same. Sponsor reserves the right to disqualify from the Promotion any participant it believes has violated these Official Rules. Sponsor may prohibit a participant from participating in the Promotion or winning the prize if, in its sole discretion, the Sponsor determines that said participant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants, Sponsor, or any of the Promotion Entities. If for any reason the Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select a winner from those entries received up to the cancellation/suspension date.

CAUTION AND WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE PROMOTION WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT, TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. In the event of any conflict with any details contained in these Official Rules and any details contained in any promotional materials of the Promotion (including, but not limited to, point-of-sale, television and print advertising, promotional packaging, and other promotional media), the details of the Promotion set forth in these Official Rules shall prevail.

LIMITATION OF LIABILITY: By participating, participants acknowledge and agree that Sponsor and the Promotion Entities and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) are not responsible for, and shall have no liability for (1) entries that contain incomplete or inaccurate information or do not otherwise comply with these Official Rules; (2) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged, garbled, misdirected, or otherwise not received by Sponsor or its agents for any reason; (3) any typographical or other error in the printing or advertising of this Promotion, the administration or execution of this Promotion, or in the announcement of a prize winner; or (4) any problems or technical malfunctions, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion.

By participating in the Promotion, participants agree to be bound by the Official Rules of the Promotion and all decisions of Sponsor which are final and binding in all respects. Except where prohibited by law, by participating in the Promotion, participants and winners agree to and hereby waive, release, discharge, indemnify and hold harmless the Released Parties from and against (A) any and all liability, for loss, harm, damage, injury, cost or expense whatsoever with respect to or in any way arising from the Promotion and/or use of the prize, including, without limitation, property damage, liability for personal injury (including emotional distress), and/or death caused, in whole or in part, directly or indirectly, from the awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or participation in any Promotion-related activity or participation in the Promotion, and (B) for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor reserves the right, in its sole discretion, to disqualify any individual Sponsor finds to be (i) tampering with the entry process or the operation of the Promotion, or (ii) acting in violation of these Official Rules. If Sponsor determines, in its sole discretion, that this Promotion cannot be executed as planned, including, but not limited to, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupts or affect the security, administration, fairness, integrity, or proper conduct of this Promotion, or if this Promotion is compromised in any way, electronically or otherwise, Sponsor reserves the right to terminate this Promotion, and to award the prize by random drawing from all eligible entries received prior to the date of cancellation or suspension.

DISPUTES: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules, which would cause the application of laws of any jurisdiction other than the State of Georgia. If any part of these Official Rules is deemed to be invalid or otherwise unenforceable or illegal, the balance of the Official Rules shall remain in full force and effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Except where prohibited, participants agree that (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, and exclusively by a federal or state court located in Georgia, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, and (3) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

PUBLICITY RIGHTS: By participating in the Promotion and/or accepting a prize, each participant agrees to allow Sponsor and its designees the perpetual worldwide right to use and/or publish participant’s name, biographical information, photos and/or other likeness, entry comments, and statements, in whole or in part, for promotion, trade, commercial, advertising, and publicity purposes, at any time or times, in all media now known or hereafter discovered, without additional compensation or notice to participant, or review or approval by the winner, except where prohibited by law.

PRIVACY POLICY: Any personal information collected during a participant’s participation in the Promotion will be collected by Sponsor or its designee and used by Sponsor, and its affiliates, designees, agents, and marketers for the purposes of the proper administration and fulfillment of the Promotion as described in these Official Rules and otherwise in accordance with Sponsor’s Privacy Policy as stated at https://canyonglutenfree.com/bread/policies.

For a list of winners, mail a self-addressed, stamped business envelope to: Winners List, Canyon Bakehouse – Candid Canyon Promotion, 3600 Ronald Reagan Blvd, Johnstown, CO 80534. Winners list requests must be received no later than December 31, 2021.
